1. Identification of the seller
The seller is Marco Greco, a sole trader operating under the commercial name GM COMMERCE, tax ID (NIF) Y6825275Q, with address at CR Menores – Taucho, 87, Finca El Conejo, 38677 Adeje, Santa Cruz de Tenerife, Spain. Contact e-mail: info@gmcommerce.es.
2. Scope and acceptance
These Terms govern the distance sale of the products offered at gmcommerce.es to consumers resident in the European Union, within the meaning of Spanish Royal Legislative Decree 1/2007 (TRLGDCU) and Directive 2011/83/EU.
Before completing the order, the customer must expressly accept these Terms by ticking the relevant box, which is not pre-ticked. Placing the order implies full acceptance of this version, which will be stored with the order and sent to the customer on a durable medium with the order confirmation.
The contract may be concluded in Spanish, English or French. In the event of any discrepancy between versions, the Spanish version prevails.
3. Products and pre-contractual information
Each product page states its main characteristics, the total price and the estimated delivery time. Photographs are indicative and may differ in colour or finish from the actual product due to screen settings.
Offers are subject to availability. If a product is unavailable after the order has been confirmed, GM COMMERCE will inform the customer without delay and refund the full amount paid within a maximum of 14 calendar days.
4. Prices, taxes and customs duties
All prices are expressed in euros (EUR).
4.1. Sales model. Products are dispatched from warehouses located outside the customs and tax territory of the European Union. Each order therefore constitutes an importation into the customer’s country of destination.
4.2. VAT. For consignments with an intrinsic value of EUR 150 or less, GM COMMERCE collects at the time of purchase the VAT due in the Member State of destination through the Import One-Stop Shop (IOSS) scheme, in accordance with Articles 369l et seq. of Directive 2006/112/EC. The price shown includes that VAT.
4.3. Customs duties. From 1 July 2026, consignments valued below EUR 150 are no longer exempt from customs duty in the European Union and a flat-rate duty of EUR 3 applies for each category of item contained in the consignment. GM COMMERCE bears this amount in full, together with any other applicable customs duty or clearance charge.
4.4. Final price. The amount shown at the last step of the checkout, before confirmation of the order, is the total and final price and includes the product, destination VAT, customs duties, clearance charges and shipping costs. The customer will not have to pay any additional amount on delivery.
4.5. Canary Islands. Consignments to the Canary Islands, Ceuta and Melilla are not subject to VAT. In the Canary Islands GM COMMERCE operates under the IGIC special scheme for small traders (REPEP).
GM COMMERCE reserves the right to change prices at any time; the applicable price is always the one in force when the order is confirmed.
5. Ordering process
- Selection of products and addition to the basket.
- Entry of shipping and billing details.
- Choice of shipping method and payment method.
- Review of the order summary, with a breakdown of the total price.
- Express acceptance of these Terms and of the Privacy Policy.
- Confirmation by means of a button unambiguously labelled Order with obligation to pay.
Before confirming, the customer may correct any input errors by returning to the previous steps. Once the order is completed, a confirmation will be sent by e-mail on a durable medium, with the order summary and these Terms.
6. Payment methods
The accepted payment methods are shown during checkout. Payment is processed through authorised payment service providers in a secure, encrypted environment. GM COMMERCE never stores full payment card details.
The charge is made when the order is confirmed. If payment is declined, the order will not be considered concluded.
7. Shipping and delivery
Shipping methods, times and destinations are set out in the Shipping Policy, which forms an integral part of these Terms.
Unless a different period is stated on the product page or during checkout, GM COMMERCE will deliver the products without undue delay and in any event within a maximum of 30 calendar days from conclusion of the contract. If that period is not met, the customer may call on GM COMMERCE to deliver within an additional appropriate period and, failing that, terminate the contract with the right to a full refund.
The risk of loss or damage passes to the customer when the customer, or a third party designated by the customer other than the carrier, acquires physical possession of the goods.
8. Right of withdrawal
Consumers have 14 calendar days to withdraw from the contract without giving any reason. The conditions, exceptions and procedure are set out on the Withdrawal and Returns page.

9. Legal guarantee of conformity
Products are covered by the legal guarantee of conformity. Conditions and periods are set out on the Legal Guarantee page.
10. Customer service and complaints
Any query, issue or complaint may be addressed to info@gmcommerce.es. GM COMMERCE will acknowledge receipt of complaints and reply as soon as possible and in any event within one month.
GM COMMERCE holds official complaint forms available to consumers, which will be sent by e-mail on request.
11. Alternative dispute resolution
Consumers may contact the consumer protection bodies of their place of residence or, in Spain, the Consumer Arbitration Boards and Municipal Consumer Information Offices.
Please note that the European Online Dispute Resolution (ODR) platform ceased operating on 20 July 2025 following the repeal of Regulation (EU) 524/2013, so complaints can no longer be submitted through it.
12. Force majeure
GM COMMERCE shall not be liable for failure to perform its obligations where this is due to force majeure beyond its control, such as natural disasters, labour disputes, customs closures or widespread disruption of transport or telecommunications. This does not affect the customer’s right to terminate the contract and obtain a refund if delivery becomes impossible.
13. Severability
If any clause of these Terms is held void or unenforceable, this shall not affect the validity of the remainder, which shall continue to apply in full.
14. Applicable law and jurisdiction
These Terms are governed by Spanish law. For consumers resident in other European Union Member States, the mandatory consumer protection provisions of their country of habitual residence apply in any event (Art. 6 of Regulation (EC) 593/2008, Rome I), and the consumer may sue and be sued in the courts of their domicile (Arts. 17 to 19 of Regulation (EU) 1215/2012).
