1. Right of withdrawal
As a consumer, you have the right to withdraw from the contract within 14 calendar days without giving any reason (Arts. 102 et seq. TRLGDCU and Art. 9 of Directive 2011/83/EU).
The period begins on the day on which you, or a third party indicated by you other than the carrier, acquires physical possession of the goods. If the order is delivered in several consignments, the period begins with receipt of the last one.
2. How to exercise the right
You may exercise it in any of these ways:
- Using the Withdraw from the contract function, permanently available in the site footer.
- Sending an unequivocal statement to info@gmcommerce.es.
- Sending the model withdrawal form reproduced at the end of this page, by e-mail or post.
To meet the deadline it is sufficient that the communication is sent before the period expires. GM COMMERCE will acknowledge receipt of the withdrawal without delay, on a durable medium.
3. Effects and refund
GM COMMERCE will refund all payments received, including the standard delivery costs, without undue delay and in any event within a maximum of 14 calendar days from the date on which it is informed of your decision.
The refund will be made using the same means of payment used for the purchase, unless you expressly agree otherwise; you will not incur any fees as a result of the refund.
GM COMMERCE may withhold the refund until it has received the goods back or until you have supplied evidence of having sent them back, whichever is the earliest.
If you chose a delivery method other than the cheapest standard one, the difference in cost will not be refunded.
4. Returning the goods
You must send back the goods without undue delay and in any event no later than 14 calendar days from the day you communicate your decision.
Given the international origin of shipments, GM COMMERCE will state in the acknowledgement the return address applicable to your order. The direct cost of returning the goods is borne by the consumer, except where the product is defective or not in conformity, in which case GM COMMERCE bears it. These costs are estimated at a maximum of EUR 15 for shipments within the European Union.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.
5. Exceptions to the right of withdrawal
Under Article 103 TRLGDCU, there is no right of withdrawal for contracts relating to:
- Goods made to the consumer’s specifications or clearly personalised.
- Goods liable to deteriorate or expire rapidly.
- Sealed goods which are not suitable for return for health protection or hygiene reasons and which were unsealed after delivery.
- Goods which, after delivery and by their nature, are inseparably mixed with other items.
- Sealed audio or video recordings or sealed computer software unsealed by the consumer.
- Digital content not supplied on a tangible medium, where performance has begun with the consumer’s prior express consent and acknowledgement of the loss of the right of withdrawal.
